FREEBIES REWARDS® PROGRAMME

 Applying for membership

1. Information on how to apply to and become a member of the Freebies Rewards® Programme (“The Programme”) and claim offers and prizes form part of these terms and conditions (Terms and Conditions). By applying for membership to the Programme, a participant is deemed to accept and agrees to be bound by these Terms and Conditions.
2. The Programme Administrator may revise these Terms and Conditions from time to time without notice to participants. Since participants are bound by the most current version of these Terms and Conditions, a participant should periodically check the Terms and Conditions. A participant's continued membership to the Programme following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes.
3. Membership to the Programme is free and open to all Australian residents aged 15 years or older.
4. There are three (3) categories of membership; 'Customer', 'Federation Centres Staff' (includes the directors, management and employees of the Programme Administrator) and 'Centre Staff' (includes the management and employees of participating retailers).
5. To apply for membership to the Programme, an eligible participant must either:-
a. Attend a shopping centre participating in the Programme and visit a 'Freebies' machine. The eligible participant must then follow the instructions on the 'Freebies' machine to provide the required information. 
b. Join 'Freebies' through visiting the Programme's website at www.freebiesrewards.com.au, or through visiting one of the participating centre's websites and providing the required information (required information may include, but is not limited to, their full name, age, residential address, telephone number, current and valid email address). 
c. Download the Freebies mobile application (available for Android and iTunes) (“Freebies App), touch the ‘Freebies’ icon and provide the required information (required information may include, but is not limited to, their full name, age, residential address, telephone number, current and valid email address, username and password.
6. Incomplete, ineligible or incomprehensible membership applications will not be valid.
7. Participants aged under 18 years must obtain the consent of their parent or legal guardian to apply for membership of the Programme and provide Personal Information about themselves. Participants who are under the age of 18 years and apply for membership of the Programme without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Terms & Conditions will bind the participants and any parent or legal guardian who gives their consent (for entrants aged under 18 years). 
8. The Programme Administrator may refuse any application for membership in their sole discretion. An eligible participant who completes the application process via the ‘Freebies’ machines or the shopping centre websites in the manner required and whose application is accepted will then be issued a temporary membership card, which can be used immediately until a permanent membership card is issued. A permanent membership card will either be mailed to the eligible participant at their nominated address, or will be available for collection from Centre Management or the customer service desk within the participating shopping centre. An eligible participant who completes the application process via the Freebies App will receive a permanent electronic membership card, which will be stored in their App. 
9. Incomplete applications will be deemed invalid. No responsibility will be taken for lost or misdirected applications.
10. Participants can only apply for membership in their own name. The Programme Administrator and participating shopping centres reserve the right to request a participant produce (within the requested time) appropriate photo identification or other documentation (to the Programme Administrator or participant retailer's satisfaction, at their sole discretion) in order to confirm their identity, age, residential address, eligibility to apply for Programme membership, and any information submitted by the participant in applying for membership to the Programme, before issuing a membership card and admitting the participant into the Programme (including confirming consent of a participant’s legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an entrant is under 18 years of age). If the documentation required by the Programme Administrator or participating shopping centres is not received by the Programme Administrator or participating shopping centre or a participant's details have not been verified or validated to the Programme Administrator's or a participating shopping centre's satisfaction within the time requested, the participant will not be issued a membership card and will not be admitted to the Programme. Membership cards will only be issued within a participating shopping centre following any participant validation and verification that the Programme Administrator or participating shopping centres require in their sole discretion.
11. Each eligible participant is limited to one membership of the Programme only. The one membership card (including electronic cards) can be used at multiple participating shopping centres. Any subsequent applications received from an eligible participant after their first membership application is received will be deemed invalid.
12. Freebies Rewards® Membership cards can only be scanned at the 'Freebies' machine by the owner of that Membership Card. Any customer caught scanning a membership cards that is not registered in their own name is engaging in fraudulent behaviour and may result in the termination of both customers' Memberships. Suspension and termination is at the discretion of the Programme Administrator.
13. Each participant using the Freebies App is responsible for maintaining the strict confidentiality of their login details for the Freebies App and is responsible for any activity under their account. Each participant agrees to immediately notify the Programme Administrator of any unauthorised use of their account or password or any other breach of security. It is the participant’s sole responsibility to control the dissemination and use of their password and control access to and use of their account. The Programme Administrator will not be responsible or liable for any loss or damage arising from a participant’s failure to comply with this provision.
14. If an participant uses social media to participate in a Promotion: participants acknowledge that their personal social media site may be updated by accessing the Programme via social media, including Facebook, Twitter and any other social media platform (Social Media Platforms). Further, participants consent to the disclosure and transfer of their Personal Information, by Compco to Social Media Platforms for purposes relating to the Programme. Membership to and use of Social Media Platforms generally is subject to the prevailing terms and conditions of use of the Social Media Platform. The Programme is in no way sponsored, endorsed or administered by, or associated with, any Social Media Platform. Participants are solely responsible and liable for any content or information they transmit to other internet users. To the extent permitted by law, each participant agrees to indemnify, defend and forever hold harmless, Compco and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by a participant in respect of the participant’s participation in the Programme. Any questions, comments or complaints about the Programme must be directed to the Promoter and not to any Social Media Platform.
15. Membership cards are not credit or charge cards, are not transferable or redeemable for cash, and remain the property of the Programme Administrator. A participant must immediately notify the Programme Administrator of a lost or stolen membership card. The Programme Administrator is not liable for any delay in replacing a membership card or for any unauthorised use of a membership card.
16. The Programme Administrator and a participating shopping centre may terminate or suspend any persons membership of the Programme in their sole discretion and without notice for any reason including, without limitation, if the participant: fails to comply with these Terms and Conditions; abuses any privilege accorded to the participant under the Programme; supplies any misleading information or makes any misrepresentations to the Programme Administrator or to any participating shopping centre in connection with the Programme; does not use his or her membership card for a period of 12 months; dies; or becomes bankrupt.
17. A participant may terminate his or her membership to the Programme at any time by giving written notice to the Programme Administrator.
18. The Programme Administrator reserves the right to verify the validity of membership applications and reserves the right to disqualify any participant for tampering with the application process or for submitting an application which is not in accordance with these Terms and Conditions, or if the participant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Programme. The Programme Administrator's legal rights to recover damages or other compensation from such an offender are reserved.
19. The Programme Administrator's decision in relation to all aspects of the Programme is final and no correspondence will be entered into.
20. The Programme Administrator, participating shopping centres and the participating retailers and their associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with their membership to the Programme or their use of a gift, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
21. Any tax, liability or duty arising from a participant's membership to or participation in the Programme is the responsibility of each participant.
22. Participating retailers do not have any authority, express or implied, to make any representation, warranty or statement on behalf of the Programme Administrator and the Programme Administrator accepts no liability in respect of such representations, warranties or statements.
23. Caution: any attempt to cause malicious damage or interference with the normal functioning of the 'Freebies' machine, the Programme Administrator's or participating shopping centre's website or the information on the website, or Freebies App or to otherwise undermine the legitimate operation of the Programme may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Programme Administrator reserves the right to seek damages to the fullest extent permitted by law. If the Programme Administrator suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by a participant, the participant agrees to indemnify the Programme Administrator for those losses, damages and costs.
24. The Programme Administrator or participating shopping centres are not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to a participant's or any other person's mobile handset or computer related to, or resulting from, participation in the Programme or the downloading of any materials related to the Programme.
25. If for any reason the Programme is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Programme Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Programme, the Programme Administrator reserves the right subject to state regulatory approval to cancel, terminate, modify or suspend the Programme.
26. The Programme Administrator reserves the right to suspend or terminate the Programme at any time without prior notice. The Programme Administrator will not be liable for the suspension or termination of the Programme on any account whatsoever including (without limitation) for any membership points balance in a participant's account at the time of suspension or termination.
27. The Programme Administrator reserves the right to suspend or terminate a participant's accumulated points without prior notice.
28. The use of any automated software or any other mechanical or electronic means that allows a participant to automatically apply for Programme membership, obtain vouchers or claim gifts is prohibited.
29. The Programme Administrator will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the Programme, if the deficiency is occasioned by any cause outside the reasonable control of the Programme Administrator.
30. All membership applications and any copyright subsisting in the applications become and remain the property of the Programme Administrator. 
31. Participants authorize the Program Administrator to collect, use, store, disclose, or otherwise process Personal Information about a participant for the following primary purposes:-
a. to include an participant in the Program and where appropriate award prizes;
b. to enable the Program Administrator to share a participant’s Personal Information with participating retailers and participating third parties so that they might improve their goods and services; and/or
c. to provide and improve any other services which are generally made available by the Program Administrator from time to time;
If the Personal Information requested is not provided, the participant may not participate in the Program. 
44 By participating in the Program, a participant consents to the Program Administrator, and/or its participating retailers and participating third parties, contacting it in the future with information on special offers and/or to provide the participant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future (altogether these are “Direct Marketing Materials”). If a participant does not wish to receive Direct Marketing Materials, they will be given the option to request not to receive such materials. 
45 Where the Program Administrator’s related entities, and/or participating retailers, participating third parties, and/or Social Media Platforms are located overseas, participants consent to the Program Administrator sharing their Personal Information, with these entities for the primary purposes outlined at clause 45 above,.. Participants also acknowledge that having provided this consent, clause 8.1 of APP 8 contained in Schedule 1 of the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth) will not apply to their Personal Information where that information is located in a foreign jurisdiction.
46 An Participant may gain access to, update or correct any Personal Information by contacting the Program Administrator at the address below. A copy of the Program Administrator's Privacy Policy in relation to the treatment of Personal Information is available by contacting the Program Administrator.
47 For the purposes of these Terms and Conditions Personal Information means all information about an individual that is Personal Information under the Privacy Act 1988 (Cth).
48 In the event of any inconsistency between these Terms and conditions and any other document which forms part of these Terms and Conditions by reference or is related to an Entrant’s participation in the Programme and/or an advertised promotion or competition, these Terms and Conditions will take priority.

WINME TICK TOCK GAME (NATIONAL MINOR PRIZES)
TERMS AND CONDITIONS


1. Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into an advertised Winme Tick Tock Game (National Minor Prizes) promotion (each, a Promotion) is deemed acceptance of these Terms and Conditions. 

2. The promoter is The Competition Company Pty Ltd (ABN 67 088 546 043) trading as Compco Digital of Studio 2/11 Carlisle Street, Tamarama NSW 2026 (Promoter). Telephone: 1800 002 099.

PROMOTIONAL DATES AND DRAWS

3. Blanket period will commence at 6:00am (AEST) on 19 February 2014 and will close at 11:00pm (AEDT) on 18 October 2014. The start, finish and draw dates and times for each Promotion will be as advertised on the Winme application and the Freebies Rewards® application (each, a Promotional Application). The draws for each Promotion will take place at the Promoter’s premises. The winner(s) of each draw will be notified in writing. The names and localities of NSW winners of prizes valued over $500.00 and ACT winners of prizes valued at $1,000.00 will be published in a relevant publication (as required under the applicable State or Territory lottery legislation) within twenty-eight (28) days of draw as advertised for the relevant Promotion. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

ELIGIBILITY

4. Entry into a Promotion is only open to residents of Australia aged 15 years or older who:

a. are or become members of the Winme Rewards programme (Programme) in the manner required and remain members of the Programme for the duration of the promotional period for that Promotion; and

b. have one (1) or more entry points in the Programme (Entry Points),

(together, Entrants).

5. The software providers and developers (and their employees) of the Programme and the directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of a Promotion are ineligible to enter the Promotion. 

6. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the Promotion and provide personal information about themselves. All entries of Entrants who are under the age of 18 years and enter the Promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Terms and Conditions will bind the Entrants and any parent or legal guardian who gives their consent (for Entrants aged under 18 years). If any prize winner is aged under 18 years, the prize will be awarded to the parent or legal guardian who consented to the winner entering the Promotion on behalf of the winner, at the sole discretion of the Promoter.

7. Only one (1) Programme membership per person permitted. Any subsequent registration to the Programme after the first valid registration of an Entrant is received will be deemed invalid and may result in termination of all of the Entrant’s membership accounts by the Promoter in its sole discretion for breach of this condition. 

HOW TO COLLECT ENTRY POINTS

8. Entrants can collect Entry Points in accordance with the instructions on the Promotional Applications, which may include:

a. successfully scanning their Programme membership card against a Freebies Rewards® machine located at a participating centre in Australia (Promotional Machine);

b. accessing a Promotional Application via their compatible device in the manner required;

c. sharing a Promotional Application on social media in the manner required; and

d. sharing a Promotional Application electronically (other than on social media) with their friends or relatives in the manner required. The operation of this referral mechanic is subject to the Spam Act 2003. Each Entrant’s relative or friend to whom the Promotional Application is shared must be an Australian resident aged 15 years or older. Each Entrant warrants that any and each friend or relative to whom they share the Promotional Application is known to them personally and that they have permission to send electronic communications to such persons; and

e. scanning the barcode or ‘Quick Response’ (QR) code on a promotional advertisement in the manner required via wireless application protocol (WAP) and/or mobile Internet on the Entrant’s compatible mobile phone.

9. The Promotional Applications are available free of charge. There is no cost associated with collecting Entry Points, other than standard data charges of the Internet Service Provider or carrier (if applicable) as set out in Conditions 13 and 15. The number of Entry Points that Entrants can collect in accordance with Condition 9 will be as stated on the Promotional Applications. Entrants may access their total cumulative number of Entry Points on the Promotional Applications.

HOW TO ENTER A PROMOTION

10. To enter a Promotion, Entrants must, during the promotional period for the Promotion, use any one (1) or more of their Entry Point(s) by either:

a. visiting a Promotional Machine, successfully scanning their Programme membership card against the Promotional Machine and nominating the number of Entry Point(s) to enter into the draw for that Promotion in the manner required; 

OR

b. logging into the Winme Tick Tock game (Promotional Game) on a Promotional Application via their compatible device using Internet or mobile Internet (carrier’s standard data charges apply), successfully submitting their Programme membership number located on the back of their membership card and nominating the number of Entry Point(s) to enter into the draw for that Promotion in the manner required.

11. Entrants will automatically obtain one (1) entry into a Promotion for each Entry Point used during the promotional period for that Promotion in accordance with Condition 11. Multiple entries accepted into each Promotion however each entry must be based on the use of one (1) separate Entry Point and must independently comply with these Terms and Conditions. 

12. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly by an Entrant for the purpose of their membership in the Programme will deem any entry of that Entrant invalid. 

13. Costs associated with downloading, accessing and/or sharing a Promotional Application remain an Entrant’s responsibility and may vary depending on the Internet Service Provider, usage plan or mobile carrier used. 

14. If an Entrant uses QR code, WAP and/or mobile Internet to participate in a Promotion: Entrants must have the bill payer’s consent to use QR code, WAP and/or mobile Internet to participate in the Promotion or their entry will be deemed invalid. Some service providers and call plans may not provide access to QR code, WAP and/or mobile Internet. Entrants must check with their service provider if unsure. Accessing mobile content including web-based content may incur data charges. Any external links (such as links clicked through the Apple App Store or Google Play) and Promotional Application features that require Internet connection may also incur data charges. Entrants will need to refer to the terms of the contracts with their carrier or Internet Service Provider (as applicable) for costs, as costs vary from plan to plan. The charges for all data services will appear on each Entrant's next mobile phone bill and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to the Entrants' mobile phone carrier or Internet Service Provider (as applicable).

15. If an Entrant uses social media to participate in a Promotion: Entrants acknowledge that their personal social media site may be updated by accessing and/or sharing a Promotional Application via social media, including Facebook, Twitter and any other social media platform. Membership to and use of social media platforms generally is subject to the prevailing terms and conditions of use of the social media platform. The Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform. Entrants understand that they are providing their information to the Promoter and not to any social media platform. Entrants are solely responsible and liable for any content or information they transmit to other Internet users. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, all social media platforms and their associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the Promotion. Any questions, comments or complaints about the Promotion must be directed to the Promoter and not to any social media platform.

16. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

PRIZES

17. For each Promotion, up to the amount of eligible entries as advertised for the Promotion will be drawn from all entries received during the promotional period for that Promotion. Each eligible entry drawn will win one (1) prize pack containing the prize(s) as advertised for the relevant Promotion. Prize packs will contain prize(s) that may include a combination of one (1) or more of the following prize types: cash, entertainment tickets, entertainment vouchers, shopping vouchers, electrical or electronic goods, homewares, home or outdoor appliances or products, home entertainment goods, bonus Entry Points, holiday vouchers, gift vouchers, health or beauty products or services, magazine subscriptions, exercise equipment and consumer goods or services. The value of each prize pack will be as advertised for the relevant Promotion up to a maximum value of $1,000.00. Total value of all prize(s) awarded in each Promotion will not exceed $5,000.00. 

18. Additional Terms and Conditions in respect of the prizes are detailed in Schedule 1.

19. It is a condition of accepting a prize that the winner and their companion(s) (if any and as applicable) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.

20. Prizes are not transferable, refundable or exchangeable and cannot be taken as cash (unless otherwise indicated). A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST (where applicable)

GENERAL

21. For each Promotion, an unclaimed prize draw will take place at the same time and place as the original draw for the Promotion, no earlier than three (3) months and one (1) day after the original draw as advertised for the relevant Promotion, as is necessary in order to distribute any prize(s) in the Promotion unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. Winner(s) in any unclaimed prize draw(s) will be notified in writing. The names and localities of any NSW winner(s) of unclaimed prize(s) valued over $500.00 and any ACT winner(s) of unclaimed prize(s) valued at $1,000.00 will be published in a relevant publication (as required under the applicable State or Territory lottery legislation) within twenty-eight (28) days of unclaimed prize draw as advertised for the relevant Promotion. All reasonable steps to notify winners of the results of any unclaimed prize draw(s) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

22. Entrants can only register as a member in the Programme and enter a Promotion in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation including showing their original Programme membership card (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, Programme membership, eligibility to enter and claim a prize, and any information submitted by the Entrant upon registering as a member of the Programme and entering the Promotion, before issuing a prize (including confirming consent of an Entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an Entrant is under 18 years of age). If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.

23. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Terms and Conditions; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of a Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

24. Any attempt to cause malicious damage or interference with the normal functioning of a Promotional Machine, a Promotional Application, the QR code, WAP or any mobile Internet application (as applicable), the information on a Promotional Machine or a Promotional Application, or to otherwise undermine the legitimate operation of a Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

25. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.

26. If a Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.

27. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of each Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to a Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, a Promotion as a result of any technical malfunctions, delays or failures (including but not limited to technological breakdown or malfunction of a Promotional Machine or a Promotional Application); (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.

28. As a condition of entering a Promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicizing or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

29. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Entrant to include the Entrant in a Promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the Promotion and is deemed ineligible. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation. 30. By participating in a Promotion, an Entrant also acknowledges that a further primary purpose for collection of the Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. 1. All prizes include delivery to the winner’s ordinary residential address in Australia.

2. All prizes are subject to these Terms and Conditions and the prize supplier’s prevailing terms and conditions of use of the prize.

3. Any tickets, passes or vouchers awarded as part of a prize are also subject to their prevailing terms and conditions of use, including expiry dates, and are not replaceable if lost, stolen or damaged. 

4. For all prizes other than cash and vouchers, all costs no expressly stated, but which may be incurred in acceptance and use of the prize, are the responsibility of the winner.

5. The Promoter reserves the right to request a winner’s companion(s) (if any and as applicable) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the companion(s)’ (if any) identity and age before issuing the prize.

1. 1. Each gift voucher entitles the winner to redeem any one (1) or more goods or services offered by retailers of participating centres or centre management to the value of the gift voucher, as stated on the gift voucher and as advertised for the relevant Promotion.

2. Gift vouchers are partially redeemable. Any value of a gift voucher that is not redeemed prior to expiry or taken for any reason will be forfeited. Any cost in excess of the value of a gift voucher will be the responsibility of the winner. 

Shopping Vouchers

1. Each shopping voucher entitles the winner to redeem any product(s) at a store of the winner’s choice between the selection of stores nominated by the Promoter in its sole discretion, to the value of the voucher as stated on the voucher and as advertised for the relevant Promotion. 

2. Shopping vouchers are partially redeemable. Any value of a shopping voucher that is not redeemed prior to expiry or taken for any reason will be forfeited. Any cost in excess of the value of a shopping voucher will be the responsibility of the winner.

Electrical/Electronic Goods

1. Each electrical or electronic goods prize comprises of one (1) or more manufacturer’s electrical item(s) and/or electronic consumer good(s) offered by retailers of participating centres, as advertised for the relevant Promotion.

1. Each home entertainment goods prize comprises of one (1) or more manufacturer’s home entertainment good(s) offered by retailers of participating centres, which may include televisions, DVD players/recorders, sound systems/players or movie projectors, as advertised for the relevant Promotion.

1. Each homewares prize comprises of one (1) or more homeware item(s) offered by retailers of participating centres, as advertised for the relevant Promotion. 

Home/Outdoor Appliances/Goods

1. Each home or outdoor appliances or goods prize comprises of one (1) or more home or outdoor appliance(s) or good(s) offered by retailers of participating centres, as advertised for the relevant Promotion. 

Bonus Entry Points

1. Each bonus Entry Points prize comprises of the number of Entry Points as advertised for the relevant Promotion, which will be directly transferred into the winner’s Programme membership account and may be used by the winner to enter into subsequent Promotion(s). 

Holiday Vouchers

1. Each holiday voucher entitles the winner and one (1) or more companion(s) as stated on the voucher (if the winner is aged under 18 years, their companion (or one (1) of their companions, if applicable) must be the winner’s parent or legal guardian who consented to the winner entering into the Promotion) to a holiday within Australia, which may include travel and/or accommodation, as stated on the holiday voucher and as advertised for the relevant Promotion. 2. 1. Each magazine subscription prize entitles the winner to receive one (1) subscription to one (1) magazine of the winner’s choice between the selection of magazines nominated by the Promoter in its sole discretion and for the duration as advertised for the relevant Promotion. 

Exercise Equipment

1. Each exercise equipment prize comprises of one (1) or more exercise equipment (s) offered by retailers of participating centres, as advertised for the relevant Promotion. 

2. Each winner must attend, undergo and pass any appropriate training, briefings, safety demonstrations and other requirements of the Promoter and/or the prize supplier in respect of this prize, as determined by the Promoter and/or the prize supplier in their absolute discretion.

Consumer Goods/Services

1. Entry into the ‘Freebies’ Program Spin and Win promotion (Promotion) is deemed acceptance of these terms and conditions. 3. The Promotion will be conducted in up to sixty-one (61) individual participating shopping centres Australia wide (excluding the Northern Territory and the Australian Capital Territory) (Participating Centres). The Participating Centres will be divided into Participating Centres with a kiosk (Participating Kiosk Centres) and Participating Centres without a kiosk (Participating Non Kiosk Centres) for the purpose of determining the mechanics of entry into the Promotion. There will be up to thirty-six (36) Participating Kiosk Centres and up to twenty-five (25) Participating Non Kiosk Centres Australia wide (excluding the Northern Territory and the Australian Capital Territory). These terms and conditions apply to each Participating Centres except where context indicates otherwise. 4. The Promotion will commence at 6:00am (local time) on 26 October 2014 and will close at midnight (local time) on 25 October 2015 (Promotional Period). 
5. The Promotion is only open to residents of Australia aged 15 years or older who, during the Promotional Period:
a. are or become members of the ‘Freebies’ Program (Program) in the manner required in the relevant membership category, as follows:

i. ‘Customers’: customers of the Participating Centres (excluding Promoter Staff and Centre Staff); 
ii. ‘Promoter Staff’: the directors, management and employees of the Promoter, its related entities, suppliers, providers and agencies; or
iii. ‘Centre Staff’: the management and employees of retailers of the Participating Centres, its related entities, suppliers, providers and agencies, (each, a Membership Category); and
b. attend a Participating Centre during trading hours,(together, Entrants).
6. The software providers and developers (and their employees) of the Program are ineligible to enter the Promotion. 
7. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the Promotion and provide personal information about themselves. All entries of Entrants who are under the age of 18 years and enter the Promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These terms and conditions will bind the Entrants and any parent or legal guardian who gives their consent. If any Winner is aged under 18 years, the Prize will be awarded to the parent or legal guardian who consented to the Winner entering the Promotion on behalf of the winner, at the sole discretion of the Promoter. 
8. Only one (1) Program membership per person is permitted. Any subsequent registration to the Program after the first valid registration of an Entrant is received will be deemed invalid and may result in termination of all of the Entrant’s membership accounts by the Promoter in its sole discretion for breach of this condition. 
9. Instant win: To enter the Promotion, Entrants must, during the Promotional Period:
a. If the Entrant attends a Participating Kiosk Centre:
1. visit a ‘Freebies’ machine located in the Participating Kiosk Centre (Promotional Machine), successfully scan their Program membership card against the Promotional Machine and play the ‘Spin and Win’ game on the Promotional Machine in the manner required; or
2. access the ‘Freebies’ application (Promotional Application) in the Participating Kiosk Centre on their compatible device using geo-positioning technology via Internet or mobile Internet (carrier’s standard data charges apply), successfully submit their Program membership number located on the back of their membership card and play the ‘Spin and Win’ game on the Promotional Application in the manner required; or
b. If the Entrant attends a Participating Non Kiosk Centre: access the Promotional Application in the Participating Non Kiosk Centre on their compatible device using geo-positioning technology via Internet or mobile Internet (carrier’s standard data charges apply), successfully submit their Program membership number located on the back of their membership card and play the ‘Spin and Win’ game on the Promotional Application in the manner required; (each an Entry).
10. Entrants who enter the Promotion in accordance with Condition 9 will be immediately notified on-screen whether or not they are an instant winner and which Prize they have won (Winner). Winners will immediately receive one (1) voucher to redeem their Prize, which will either be printed from the Promotional Machine or electronically displayed on-screen on the Promotional Application (as applicable) (Voucher). Vouchers will only be issued in the name and/or membership number of Winners and are not available through any other means. 
11. There is a maximum of one (1) Entry per Entrant per day at any Participating Centre and a maximum of three (3) Participating Centres in any one day. Any subsequent Entry of an Entrant after the first valid Entry of the Entrant is received on any one (1) day of the Promotional Period at any one (1) Participating Centre will be deemed invalid. Each Entry must be submitted separately at a Participating Centre and must independently comply with these terms and conditions. Entries not submitted at a Participating Centre, as determined by the Promoter in its sole discretion, will be deemed invalid. 
12. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. Membership Category and/or contact details entered incorrectly by an Entrant for the purpose of their membership in the Program will deem any Entry invalid.
13. Entrants in each Membership Category will have the chance to win Prizes from their selected Membership Category only. Some Prizes may be offered exclusively to only one (1) Membership Category. The Promotional Application and Promotional Machines will only display the Prizes available to the applicable Membership Category. Entrants can change their Membership Category prior to entry by contacting the Customer Service Desk or Centre Management of a Participating Centre. Proof of identity and employment status may be required to confirm the Entrant’s Membership Category. 
14. The Promotional Application is available free of charge. Costs associated with downloading, accessing and using the Promotional Application remain an Entrant’s responsibility and may vary depending on the Internet Service Provider, usage plan or mobile carrier used. 
15. If an Entrant uses mobile Internet to participate in the Promotion: Entrants must have the bill payer’s consent to use mobile Internet to participate in the Promotion or their Entry will be deemed invalid. Some service providers and call plans may not provide access to mobile Internet. Entrants must check with their service provider if unsure. Accessing mobile content including web-based content may incur data charges. Any external links (such as links clicked through the Apple App Store or Google Play) and Promotional Application features that require Internet connection may also incur data charges. Entrants will need to refer to the terms of the contracts with their carrier or Internet Service Provider (as applicable) for costs, as costs vary from plan to plan. The charges for all data services will appear on each Entrant's next mobile phone bill and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to the Entrants' mobile phone carrier or Internet Service Provider (as applicable).
16. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
17. The instant prizes for each Participating Centre during the Promotional Period will only be valid at that Participating Centre issuing the Voucher (unless otherwise expressly stated) and will include a combination of one or more of the prize types particularised in the table immediately below (collectively Prizes and each a Prize) which will be randomly selected as a Prize:

18. Victorian Winners of Prizes valued over $1,000.00 will be published on the website of the Participating Centre where the Prize was awarded. This publication will commence within twenty-eight (28) days from the date the Prize was awarded and will continue for a minimum of twenty-eight (28) days from the date of publication. 
19. NSW Winners of Prizes valued over $500.00 will be published on the website of the Participating Centre where the Prize was awarded. This publication will commence within twenty-eight (28) days from the date the Prize was awarded and will continue for a minimum of twenty-eight (28) days from the date of publication. 
20. South Australian winners of Prizes valued over $250 will be published in The Australian newspaper within twenty-eight (28) days from the date the Prize was awarded.
21. To redeem a Voucher and claim a Prize, the Winner must, within the claim period as stated on the Voucher, take the original Voucher (paper or electronic) to staff at the retailer stated on the Voucher, the Customer Service Desk or Centre Management at the Participating Centre where the Voucher was issued, in accordance with the directions stated on the Voucher, and surrender the Voucher to such staff in order to collect their Prize.
22. Vouchers must be original and photocopies or images of Vouchers will not be accepted. Vouchers may only be redeemed once and are not replaceable if lost, stolen or damaged. Vouchers are subject to their prevailing terms and conditions of use, including the period for redeeming the Voucher and claiming the Prize. The Promoter accepts no responsibility for late, lost or misdirected Vouchers. Winners must claim their Prize at the Participating Centre where they entered the Promotion within the claim period as stated on the Voucher, otherwise their Prize will be forfeited. Prizes will only be valid at the Participating Centre where the corresponding Voucher was issued (unless otherwise expressly stated on the Voucher). 
23. Total potential Prize pool value is up to $2,522,400.00. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the Prize. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Prize value. All Prize values are the recommended retail price including GST (where applicable).
24. It is a condition of accepting a Prize that the Winner and their companion(s) (if any and as applicable) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.
25. Additional terms and conditions in respect of the Prizes are detailed in Schedule 1.
26. If total Prize value of unclaimed Prizes is over $50.00 in NSW (excluding Food and/or Beverage vouchers, and Entertainment Tickets) a draw will take place at 10am (AEST), Monday 25th January 2016 and any winners will be notified in writing.

GENERAL
27. Entrants can only register as a member in the Program and enter the Promotion in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation including showing their original Program membership card (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, Program membership, eligibility to enter and claim a Prize, and any information submitted by the Entrant upon registering as a member of the Program and entering the Promotion, before issuing a Prize (including confirming consent of an Entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an Entrant is under 18 years of age). If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) Entrant or Entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
28. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an Entry which is not in accordance with these terms and conditions; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 
29. A Prize will only be awarded following any Winner validation and verification that the Promoter requires in its sole discretion. Prizes will only be awarded where the Voucher surrendered to redeem the Prize fulfills all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.
30. Printing, electronic and other quality control errors will not invalidate an otherwise valid Prize claim. In the event that a Voucher fails to print from a Promotional Machine or fails to display on the Promotional Application, the Winner should contact Centre Management or Customer Service at the Participating Centre where the Prize was won. Unless otherwise due to fraud or ineligibility under these terms and conditions, all Prize claims in excess of the advertised Prize pool will be met. Vouchers will be void and ineligible to claim a Prize if stolen, forged, mutilated or tampered with in any way or if a Voucher fails the Promoter's validation tests. 
31. Any attempt to cause malicious damage or interference with the normal functioning of a Promotional Machine, the Promotional Application or any mobile Internet application (as applicable), the information on a Promotional Machine or the Promotional Application, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these terms and conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
32. If a Prize or element of a Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State legislation.
33. If this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as the Winner’s original Prize, subject to any written directions made under applicable State legislation.
34. The Promoter, its associated agencies and companies and retailers participating in the Promotion exclude all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, death, cost, loss and/or damage arising in any way out of the Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures (including but not limited to technological breakdown or malfunction of a Promotional Machine or the Promotional Application); (ii) theft, unauthorised access or third party interference; (iii) lost or damaged Entries, Prize claims or Prizes; and/or (iv) acceptance and/or use of any Prize. 
35. Applicable manufacturers and/or distributors should be contacted in regards to all Prize warranty claims. The warranty on the goods and services obtained as a result of this Promotion remains the sole responsibility of the manufacture/supplier of the Prize. 
36. By participating in the Promotion, an Entrant also acknowledges that a further primary purpose for collection of the Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. 8. All Prizes are subject to these terms and conditions and the Prize supplier’s prevailing terms and conditions of use of the Prize.

9. Any tickets, passes or vouchers awarded as part of a Prize are subject to their prevailing terms and conditions of use, including expiry dates, and are not replaceable if lost, stolen or damaged. 

10. For all Prizes other than vouchers, all costs no expressly stated, but which may be incurred in acceptance and use of the Prize, are the responsibility of the Winner.

4. Gift vouchers are partially redeemable. Any value of a gift voucher that is not redeemed prior to expiry or taken for any reason will be forfeited. Any cost in excess of the value of a gift voucher will be the responsibility of the Winner.

3. Each food and/or beverage voucher entitles the Winner to redeem any food and/or non-alcoholic beverage product(s) offered by one (1) or more retailer(s) of Participating Centres, to the value of the voucher as stated on the voucher and as advertised for the Promotion. 

4. Food and/or beverage vouchers are partially redeemable. Any value of a voucher that is not redeemed prior to expiry or taken for any reason will be forfeited. Any cost in excess of the value of a voucher will be the responsibility of the Winner.

Electrical / Electronic Goods
2. Each electrical or electronic goods prize comprises of one (1) or more manufacturer’s electrical item(s) and/or electronic consumer good(s) offered by one (1) or more retailer(s) of Participating Centres, as advertised for the Promotion. 
Home Entertainment Goods
2. Each home entertainment goods prize comprises of one (1) or more manufacturer’s home entertainment good(s) offered by one (1) or more retailer(s) of Participating Centres, which may include televisions, DVD players/recorders, sound systems/players, movie projectors and related accoutrements, as advertised for the Promotion. 
Holiday Vouchers
1. Each holiday voucher entitles the Winner and one (1) or more companion(s) as stated on the voucher (if the Winner is aged under 18 years, their companion (or one (1) of their companions, if applicable) must be the Winner’s parent or legal guardian who consented to the Winner entering into the Promotion) to a holiday within Australia, which may include travel and/or accommodation, as stated on the holiday voucher and as advertised for the Promotion. Choice of holiday destination(s) in Australia is in the Winner’s discretion, subject to availability. Redemption of holiday vouchers is to be arranged with a licensed travel agent nominated by the Promoter. 
2. Redemption of holiday vouchers is subject to availability and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including school holidays and public holidays). All components redeemed using a holiday voucher must be taken together and when offered or are forfeited. 4. Each Winner is solely responsible for ensuring that any services they receive as part of the prize is consistent with their requirements (if applicable).

SPECIAL OFFERS CONDITIONS OF ENTRY 

1. Information on how to participate in the Special Offers and the gifts comprising the Special Offers themselves form part of these Conditions of Entry. Participation in the Special Offers promotion is deemed acceptance of these Conditions of Entry by each claimant. 
2. The Special Offers are only open to claimants who are Australian residents aged 15 years or older who are existing members of the Freebies Rewards® Programme for a participating shopping centre (“Programme") and who have a current and valid temporary or permanent membership card for the Programme (Participants").
3. Participants aged under 18 years must obtain the consent of their parent or legal guardian to participate in the Special Offers and provide personal information about themselves. Participants who are under the age of 18 years and claim a Special Offer to the value of $50 or more without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Terms & Conditions will bind the Participants and any parent or legal guardian who gives their consent (for entrants aged under 18 years). If any Participant aged under 18 years claims a Special Offer to the value of $50 or more, the Special Offer will be awarded to the parent or legal guardian who consented on behalf of the Participant, at the discretion of the Promoter.
4. Special Offers connected with the Programme may take any form or be of any nature (including goods, services, products, discounts, 2 for 1 offers, etc) and will be as stated from time to time on each participating shopping centre's 'Freebie's machine(s) (“Rewards Machine") and/or upon any other media. Each Participant may also be offered the ability to check the available Special Offers and their expiry dates by password protected access to a web based portal or by using the Freebies Rewards® mobile application (“Freebies App”).
5. Participants aged under 15 years are not permitted to enter. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with the Special Offers are eligible to claim the Special Offers. The management and employees of participating retailers are eligible to claim Special Offers. Not all gifts/offers/instant major prizes are available to the Centro centre's retailers and/or employees.
6. The Promoter's decision in relation to all aspects of Special Offers and the awarding of Special Offers is final and no correspondence will be entered into.
7. To participate in an advertised Special Offer, Participants must attend a participating shopping centre, visit the 'Freebies' Machine and scan their Programme membership card (including the electronic membership card stored in the Freebies App) in the manner required. The Promoter will have access to the details of the entrant's full name, residential address, current and valid email address and contact telephone number, as provided to the Promoter in the Participant's Programme membership application. 
8. The redemption of only one (1) Special Offer per Programme Participant per day is permitted unless otherwise stated on a participating shopping centre's 'Freebies' Machine.
9. Special Offer Participants must follow the instructions on the 'Freebies' Machine to select their requested Special Offer (if applicable). A voucher for the Special Offer will then be immediately printed from the Machine. The voucher will be issued in the Participant's name.
10. To collect the Special Offer, Participants must then take the issued voucher to the location stated on the voucher and surrender the voucher to staff, who will then issue the eligible claimant with their Special Offer. The voucher must be an original and photocopies or images of vouchers will not be accepted.
11. Vouchers for a Special Offer can only be redeemed once. Any attempt to subsequently use a voucher after the first valid redemption by an eligible claimant will be invalid. Vouchers are subject to prevailing terms and conditions of use (including expiry dates) and must be redeemed by the date stated on the voucher. Special Offers may be subject to the terms and conditions of the relevant participating retailer or participating shopping centre. Vouchers are not replaceable if lost or stolen.All warranty claims in respect of Special Offers must be directed towards the applicable manufacturer and not the Promoter or participating shopping centre.
12. Each Special Offer must be taken as offered and cannot be varied. A Special Offer, or any unused portion of a Special Offer, is not exchangeable or transferable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in a Special Offer value. The Promoter accepts no responsibility for any tax implications that may arise from the receipt or use of Special Offers. Independent financial advice should be sought. 
13. Each Special Offer will be valued at up any stated value on the voucher (Recommended Retail Price including GST). 
14. If any Special Offer or any element of a Special Offer becomes unavailable for any reason beyond the Promoter's or a participating retailer's reasonable control, the Promoter and/or participating retailer reserves the right to award a similar Special Offer or Special Offer element of equal or greater value in lieu.
15. Claimants can only enter and claim Special Offers in their own name. The Promoter, participating shopping centres and participating retailers reserve the right to request a claimant produce (within the requested time) appropriate photo identification and membership card (including the electronic membership card stored in the Freebies App) and any other documentation (to the Promoter's / participating shopping centres / participating retailers satisfaction, at their sole discretion) in order to determine a claimant's identity, age, residential address and email address, eligibility to claim a Special Offer as a Participant and any information submitted by a claimant before issuing a Special Offer (including confirming consent of an entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an entrant is under 18 years of age). If the documentation required is not received by the Promoter / participating shopping centre / participating retailer (or their nominated agent) or the Special Offer claim has not been verified or validated to their satisfaction within the time requested, that claimant's claim will become invalid. All Special Offers will only be awarded following any claimant validation and verification that the Promoter / participating shopping centre / participating retailer (or their nominated agent) requires in their sole discretion.
16. Special Offer materials, including the vouchers, are void if stolen, forged, mutilated or tampered with in any way or if such materials fail the Promoter's / participating shopping centre's / participating retailer's (or their nominated agent's) validation tests in which case they will be deemed void.
17. The Promoter, the participating shopping centres and participating retailers and its or their associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking or using any Special Offer, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
18. The Promoter and a participating shopping centre reserves the right to disqualify any claimant for tampering with the claim process or for submitting a claim which is not in accordance with these Conditions of Entry, or if the claimant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Special Offer or the Programme. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
19. Caution: any attempt to deliberately damage a 'Freebies' Machine or the information on a 'Freebies' Machine, to cause malicious damage or interference with the normal functioning of a 'Freebies' Machine, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter or a participating shopping centre suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by a claimant, the claimant agrees to indemnify the promoter for those losses, damages and costs. 
20. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to claimant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion, the Programme or a Special Offer.
21. If for any reason a Special Offer, the Programme or this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion.
22. The use of any automated entry software or any other mechanical or electronic means that allows a claimant to automatically receive or redeem a Special Offer repeatedly is prohibited and will render all claims submitted by that claimant invalid.
23. The Promoter, a participating shopping centre and a participating retailer will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside their reasonable control.
24. As a condition of entering this promotion and applying for a Special Offer, a Participant consents to the Promoter and a participating shopping centre or retailer using the Participant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in the event that they are awarded a Special Offer, in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the participating shopping centre or retailer. A Participant agrees that, in the event that they are awarded a Special Offer, the Participant will participate in all reasonable promoted activities in relation to the Special Offer as requested by the Promoter, participating shopping centre and their agents.

WINME REWARDS TERMS AND CONDITIONS

APPLYING FOR MEMBERSHIP 
1. Information on how to become a member of Winme Rewards (“The Program”) and claim offers and prizes form part of these terms and conditions (“Terms and Conditions”). By applying for membership to the Program, an entrant is deemed to accept and agrees to be bound by these Terms and Conditions.
2. The Program Administrator may revise these Terms and Conditions from time to time without notice to entrants. Since entrants are bound by the most current version of these Terms and Conditions, an entrant should periodically check the Terms and Conditions. An entrant's continued membership to the Program following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes.

ELIGIBILITY
3. Entry into a Program promotion (“Promotion”) is only open to residents of Australia aged 15 years or older who:

a. are or become members of the Program during the promotional period for a Promotion by accessing the Program on a promotional application via Internet or mobile Internet (carrier’s standard data charges apply) and following the prompts to register in the manner required. The promotional applications are available free of charge;

b. remain members of the Program for the duration of the promotional period for a relevant Promotion.

4. Incomplete, ineligible or incomprehensible membership applications will not be valid.
5. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the Promotion and provide Personal Information about themselves. All entries of entrants who are under the age of 18 years and enter the Promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Terms and Conditions will bind the entrants and any parent or legal guardian who gives their consent (for entrants aged under 18 years). If any prize winner is aged under 18 years, the prize will be awarded to the parent or legal guardian who consented to the winner entering the Promotion on behalf of the winner, at the sole discretion of the Promoter.
6. The Program Administrator may refuse any application for membership in their sole discretion. 
7. Incomplete applications will be deemed invalid. No responsibility will be taken for lost or misdirected applications.
8. Only one (1) Program membership per person permitted. Any subsequent registration to the Program after the first valid registration of an entrant is received will be deemed invalid and may result in termination of all of the entrant’s membership accounts by the Promoter in its sole discretion for breach of this condition. 
9. Each entrant using the Program is responsible for maintaining the strict confidentiality of their login details for the Program and is responsible for any activity under their account. Each entrant agrees to immediately notify the Program Administrator of any unauthorised use of their account or password or any other breach of security. It is the entrant’s sole responsibility to control the dissemination and use of their password and control access to and use of their account. The Program Administrator will not be responsible or liable for any loss or damage arising from an entrant’s failure to comply with this provision.
10. Membership cards are not credit or charge cards, are not transferable or redeemable for cash, and remain the property of the Program Administrator. An entrant must immediately notify the Program Administrator of a lost or stolen membership card. The Program Administrator is not liable for any delay in replacing a membership card or for any unauthorised use of a membership card.
11. The Program Administrator may terminate or suspend any persons membership of the Program in their sole discretion and without notice for any reason including, without limitation, if the entrant: fails to comply with these Terms and Conditions; abuses any privilege accorded to the entrant under the Program; supplies any misleading information or makes any misrepresentations to the Program Administrator or to any participating third party in connection with the Program; does not use his or her membership card for a period of 12 months; dies; or becomes bankrupt.
12. An entrant may terminate his or her membership to the Program at any time by giving written notice to the Program Administrator.
13. The Program Administrator reserves the right to verify the validity of membership applications and reserves the right to disqualify any entrant for tampering with the application process or for submitting an application which is not in accordance with these Terms and Conditions, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Program. The Program Administrator's legal rights to recover damages or other compensation from such an offender are reserved.

HOW TO COLLECT ENTRY POINTS
14. Entrants can collect entry points (“Entry Points”) in accordance with the instructions on the promotional applications (“Promotional Application”) which may include:

a. successfully scanning their Program membership card against a rewards machine located at a participating centre in Australia (“Promotional Machine”);

b. accessing a Promotional Application via their compatible device in the manner required ;

c. sharing a Promotional Application on social media in the manner required; and

d. sharing a Promotional Application electronically (other than on social media) with their friends or relatives in the manner required. The operation of this referral mechanic is subject to the Spam Act 2003. Each entrant’s relative or friend to whom the Promotional Application is shared must be an Australian resident aged 15 years or older. Each entrant warrants that any and each friend or relative to whom they share the Promotional Application is known to them personally and that they have permission to send electronic communications to such persons; and

e. scanning the barcode or ‘Quick Response’ (“QR”) code on a promotional advertisement in the manner required via wireless application protocol (“WAP”) and/or mobile Internet on the entrant’s compatible mobile phone.

15. There is no cost associated with collecting Entry Points, other than standard data charges of the Internet Service Provider or carrier (if applicable). The number of Entry Points that entrants can collect in accordance with Condition 9 will be as stated on the Promotional Applications. Entrants may access their total cumulative number of Entry Points on the Promotional Applications.
16. A predetermined number of membership points (to be determined by the Program Administrator in its sole discretion) will be awarded to an entrant when they access the Program via a promotional device in the manner required. 
17. The number of membership points earned will be displayed on the promotional device once the Entrant accesses the program.
18. From time to time, bonus membership points may be issued in accordance with individual advertised offers, promotions or competitions. Program members who enter advertised promotions and competitions or otherwise take advantage of advertised offers, must do so in accordance with the applicable terms and conditions as stated on the promotional device.
19. Membership points and the rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions or unless otherwise specified. Membership points have no cash or monetary value. The Program Administrator may, in its sole discretion, determine to cancel a entrant's membership points if such points have not been used or redeemed for a continuous period of 12 months. The Program Administrator may also, in its sole discretion, elect to cancel the Program or move a entrant’s existing membership points into a new program.
20. In addition to deductions for the chances to win prizes, the Program Administrator will deduct from the membership points balance in an Entrant's account any membership points credited to the Entrant's account due to any error.

HOW TO ENTER A PROMOTION
21. To enter a Promotion, Entrants must, during the promotional period for the Promotion, use any one (1) or more of their Entry Point(s) by either:

c. visiting a Promotional Machine, successfully scanning their Program membership card against the Promotional Machine and nominating the number of Entry Point(s) to enter into the draw for that Promotion in the manner required; 

OR

d. logging into the promotional game on a Promotional Application via their compatible device, successfully submitting their Program membership number located on the back of their membership card and nominating the number of Entry Point(s) to enter into the draw for that Promotion in the manner required.

22. Entrants will automatically obtain one (1) entry into a Promotion for each Entry Point used during the promotional period for that Promotion in accordance with Condition 11. Multiple entries accepted into each Promotion however each entry must be based on the use of one (1) separate Entry Point and must independently comply with these Terms and Conditions. 
23. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly by an entrant for the purpose of their membership in the Program will deem any entry of that entrant invalid. 
24. Costs associated with downloading, accessing and/or sharing a Promotional Application remain an entrant’s responsibility and may vary depending on the internet service provider, usage plan or mobile carrier used.
25. If an entrant uses QR code, WAP and/or mobile Internet to participate in a Promotion: entrants must have the bill payer’s consent to use QR code, WAP and/or mobile Internet to participate in the Promotion or their entry will be deemed invalid. Some service providers and call plans may not provide access to QR code, WAP and/or mobile Internet. Entrants must check with their service provider if unsure. Accessing mobile content including web-based content may incur data charges. Any external links (such as links clicked through the Apple App Store or Google Play) and Promotional Application features that require Internet connection may also incur data charges. Entrants will need to refer to the terms of the contracts with their carrier or internet service provider (as applicable) for costs, as costs vary from plan to plan. The charges for all data services will appear on each entrant's next mobile phone bill and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to the Entrants' mobile phone carrier or Internet Service Provider (as applicable).
26. If an entrant uses social media to participate in a Promotion: entrants acknowledge that their personal social media site may be updated by accessing and/or sharing a Promotional Application via social media, including Facebook, Twitter and any other social media platform (Social Media Platforms). Further, participants consent to the disclosure and transfer of their Personal Information, by Compco to Social Media Platforms for purposes relating to the Program. Membership to and use of Social Media Platforms generally is subject to the prevailing terms and conditions of use of the Social Media Platform. The Promotion is in no way sponsored, endorsed or administered by, or associated with, any Social Media Platform. Entrants are solely responsible and liable for any content or information they transmit to other Internet users. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Compco and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an entrant in respect of the entrant’s participation in the Promotion. Any questions, comments or complaints about the Promotion must be directed to the Promoter and not to any social media platform.
27. The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
28. Prizes will be delivered to the entrant.
29. A prize may be subject to additional terms and conditions of a participating retailer. All warranty claims in respect of any prize (if applicable) must be directed toward the applicable manufacturer and not the Program Administrator or third party. 
30. The Program Administrator has the right to request an entrant to produce appropriate photo identification and their Program membership card (including electronic membership cards stored in the App) in order to confirm that they are the person named on a voucher, before issuing a prize. If adequate identification is not received to their satisfaction, the entrant will not be issued the prize.
31. Prizes must be taken as offered and cannot be varied. Prizes are not transferable or exchangeable and cannot be taken as cash. The Program Administrator or participating third party accepts no responsibility for any tax implications that may arise from the receipt of prizes. Independent financial advice should be sought. 
32. All prizes are subject to availability. If any prize or any element of a prize becomes unavailable for any reason beyond the Program Administrator's, participating third party’s or a participating retailer's reasonable control, the Program Administrator, participating third party or participating retailer reserves the right to award a similar prize or prize element of equal or greater value in lieu.
33. The Program Administrator's decision in relation to all aspects of the Program is final and no correspondence will be entered into.
34. The Program Administrator, participating third parties and the participating retailers and their associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with their membership to the Program or their use of a prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
35. Any tax, liability or duty arising from an entrant's membership to or participation in the Program is the responsibility of each entrant.
36. Participating retailers do not have any authority, express or implied, to make any representation, warranty or statement on behalf of the Program Administrator and the Program Administrator accepts no liability in respect of such representations, warranties or statements.
37. Caution: any attempt to cause malicious damage or interference with the normal functioning of the promotional devices, the Program Administrator's or participating third party’s website or the information on the website, or to otherwise undermine the legitimate operation of the Program may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Program Administrator reserves the right to seek damages to the fullest extent permitted by law. If the Program Administrator suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Program Administrator for those losses, damages and costs.
38. The Program Administrator or participating third parties are not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to an Entrant's or any other person's mobile handset or computer related to, or resulting from, participation in the Program or the downloading of any materials related to the Program.
39. If for any reason the Program is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Program Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, the Program Administrator reserves the right subject to state regulatory approval to cancel, terminate, modify or suspend the Program.
40. The Program Administrator reserves the right to suspend or terminate the Program at any time without prior notice. The Program Administrator will not be liable for the suspension or termination of the Program on any account whatsoever including (without limitation) for any membership points balance in an entrant's account at the time of suspension or termination.
41. The Program Administrator reserves the right to suspend or terminate an entrant's accumulated points without prior notice.
42. The use of any automated software or any other mechanical or electronic means that allows a entrant to automatically apply for Program membership, obtain vouchers or win prizes is prohibited.
43. The Program Administrator will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the Program, if the deficiency is occasioned by any cause outside the reasonable control of the Program Administrator.
44. All membership applications and any copyright subsisting in the applications become and remain the property of the Program Administrator. 
45. We automatically receive your location when you use the App. We use various technologies to determine location, such as location services of the applicable operating system or browser and sensor data from your device that may, for example, provide information on nearby Wi-Fi- access points and cell towers.
46. You consent to our collection of this personal information, and understand that we may also draw upon this in order to adapt, improve, and research the effectiveness of our services, to help users learn about businesses, locations, events and brands that are relevant to them, and for our third party partners to provide information about themselves, their locations and events to users, as well as to reward users when they visit their location or event through offers and specials. Additionally, our third party partners may have access to aggregated and anonymous data, such as anonymous check-in data (that is, not tied to individual users) of users that like their brand.
47. You authorize the Program Administrator to collect, use, store, disclose, or otherwise process Personal Information about an entrant for the following primary purposes:- 
a. to include an entrant in the Program and where appropriate award prizes; 
b. to enable the Program Administrator to share an entrant’s Personal Information with participating retailers and participating third parties so that they might improve their goods and services; and/or
c. to provide and improve any other services which are generally made available by the Program Administrator from time to time;
If the Personal Information requested is not provided, the entrant may not participate in the Program. 
46. By participating in the Program, the entrant consents to the Program Administrator, and/or its participating retailers and participating third parties, contacting it in the future with information on special offers and/or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future (altogether these are “Direct Marketing Materials”). If you do not wish to receive Direct Marketing Materials, You will be given the option to request not to receive such materials. 
47. Where the Program Administrator’s related entities, and/or participating retailers and/or participating third parties, are located overseas you consent to the Program Administrator sharing Your Personal Information, with these entities for the primary purposes outlined at clause 45 above, entrants also acknowledge that having provided this consent, clause 8.1 of APP 8 contained in Schedule 1 of the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth) will not apply to Personal Information where that information is located in a foreign jurisdiction.
48. An entrant may gain access to, update or correct any personal information by contacting the Program Administrator at the address below. All personal information will be stored at the office of the Program Administrator. A copy of the Program Administrator's privacy policy in relation to the treatment of Personal Information is available by contacting the Program Administrator.
49. For the purposes of these Terms and Conditions Personal Information means all information about an individual that is personal information under the Privacy Act 1988 (Cth).
50 In the event of any inconsistency between these Terms and conditions and any other document which forms part of these Terms and Conditions by reference or is related to an entrant’s participation in the Program and/or an advertised promotion or competition, these Terms and Conditions will take priority.
